Terms and Conditions

General Return Policy

All returns require prior authorization. Please call 1-877-203-0871 x2 to arrange for an RMA number. Opened or activated software is non-returnable.  All special order products are non-returnable. Any defective returns, authorized by VHS LLC, will be replaced with a similar or like item(s). Shipping damage must be reported immediately. Any other returns are at the sole discretion of Video Hardware Services LLC and are subject to a 20% restocking fee. Turnkey Computer systems have their own return policy found here. VHS LLC does not offer cash refunds.

You may return a turnkey computer system within 20 days of receipt provided that it returned with all the manuals, software, accessories, and packaging that shipped with the system. The system must be in a ‘LIKE-NEW’ condition, and the system must be returned in its original packaging. There may be a 15% integration and restocking fee, and shipping charges are not refundable. VHS LLC does not offer cash refunds.

NEWTEK PRODUCTS ARE NOT RETURNABLE UNDER ANY CIRCUMSTANCES. 

All installed software that has been registered or activated cannot be returned. Please wait to register or activate your software if you are not sure if you will be keeping your system.

Order Cancellations

Our turnkey workstations are all custom built to the specifications indicated on your order. We ask that when you place an order, you are absolutely sure that you want the system as configured. If changes need to be made, those changes can usually be done right up until the date of shipment (may delay shipping). Your credit card is immediately charged when you purchase a system. Credit card returns can take up to 10 business days to process.

Warranty Policy

In respect to products that are sold, but not assembled or designed by VHS LLC, you are entitled to the manufacturer's limited expressed warranty, if any, that accompanies the product. Video Hardware Services LLC makes no additional or independent warranty on any of the products sold. The company will assist in getting products repaired or replaced under a manufacturers warranty. All other warranties, express or implied, including the warranties of merchantability and fitness for a particular purpose are disclaimed. Video Hardware Services LLC shall under no circumstances be liable for special, incidental, or consequential damages including loss of profit, even if it has been advised in advance of the possibility of such damages; the maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not to exceed the purchase price of the product.

Lifetime Support Policy for Turnkey Computer Systems

Video Hardware Services LLC provides extensive support resources for your system for as long as you own your system (non-transferable).  Support includes access to resources on the web provided by VHS and its partners, e-mail support, links to drivers, etc
Telephone tech support is available from 9AM to 7PM EST M - F. Additional tech support plans are available. E-mail Support is available 24 hours a day, 7 days a week via support@videohardware.com. A broadband Internet connection is required for remote support.

Hardware Warranty Policy for Turnkey Computer Systems

Video Hardware Services, LLC ("VHS, LLC") warrants that the turnkey computer systems it manufactures will be free from defects in materials and workmanship. The standard limited warranty term is 2 years beginning on the date of invoice. Some components have manufacturer warranties that go beyond 2 years and up to 5 years. After the 1 year (or 3 year option if purchased), the customer is responsible for shipping the defective components back to the manufacturer. As always, we will help you diagnose problems though our normal support channels no matter how old your system is.

PLEASE KEEP YOUR ORIGINAL PACKAGING FOR YOUR SYSTEM. WE MAY REQUIRE YOU TO PURCHASE A BOX IF YOUR SYSTEM NEEDS TO BE SENT IN, AND THIS MAY DELAY YOUR REPAIR.

This limited warranty does not cover damage due to external causes, including accident, abuse, misuse, problems with electrical power, servicing not authorized by VHS, LLC, usage not in accordance with product instructions, failure to perform required preventive maintenance (such as keeping filters clean), and problems caused by use of parts and components not supplied by VHS, LLC.

This limited warranty does not cover any items that are in one or more of the following categories: software; monitors, keyboards, and mice, accessories or parts added to a VHS, LLC system after the system is shipped from VHS, LLC; accessories or parts added that are not installed in the VHS, LLC facility. In some cases, VHS represents the products we sell, but we have no control over the warranty of these products. During the warranty period beginning on the invoice date, VHS, LLC will repair or replace products returned to VHS LLC's facility within the warranty period. To request limited warranty service, you must contact VHS LLC's Technical Support Dept. at 603-384-1153 x203 within the limited warranty period. If limited warranty service is required, VHS LLC will issue a Return Material Authorization Number. You must ship the products back to VHS LLC in their original or equivalent packaging, prepay shipping charges, and insure the shipment or accept the risk of loss or damage during shipment. VHS LLC will ship the repaired or replacement products to you freight prepaid if you use an address in the continental United States, where applicable. Shipments to other locations must be paid in advance. These are our US terms only. During the first 60 days and while the system is under warranty, VHS will ship replacement parts Next Day service at our expense. After the first 60 days, VHS will ship replacement parts via UPS Ground service at our expense. If a customer chooses an expedited service, the customer is responsible for those charges. NOTE: Before you ship the product(s) to VHS, LLC, back up the important data on the hard-disk drive(s) and any other storage device(s) in the product(s). Although, we usually try and rescue or preserve data, anything can happen in the shipping of the system, etc. VHS LLC owns all parts removed from repaired products. VHS, LLC uses new and reconditioned parts made by various manufacturers in performing limited warranty repairs and building replacement products. If VHS, LLC repairs or replaces a product, its limited warranty term is not extended.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION). VHS LLC's RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH IN THIS LIMITED WARRANTY STATEMENT. THERE ARE NO IMPLIED OR EXPRESS WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ALL SOFTWARE SOLD IS SOLD "AS IS” WITH NO WARRANTY OF ANY KIND. VHS LLC DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS LIMITED WARRANTY STATEMENT OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST DATA OR SOFTWARE. SOME STATES (OR JURISDICTIONS) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU

Standard Terms of a Sale 

Licensing

In the event that Video Hardware Services LLC may pre-install software on a workstation that requires Video Hardware Services LLC to agree to a license agreement on your behalf, you agree to the following:
Video Hardware Services LLC will accept license agreements on your behalf for all of the software we may pre-install for you on a turnkey workstation. You agree to abide by any and all terms of such license agreements. We will provide copies of such license agreements upon your request. You agree to hold Video Hardware Services LLC, its principals, owners, and any of its partners ‘harmless’ and ‘indemnify any and all principals, owners, and partners’ should a licensing dispute arise.

All sales will be subject to the following terms and conditions:

The Customer acknowledges these terms and conditions by placing an order to purchase a product from Video Hardware Services LLC.
All sales shall be deemed made in the State of New Hampshire, USA, regardless of the location of the Customer.  The Customer also agrees that any dispute with Video Hardware Services LLC arising out of any purchase(s) by the customer shall be brought exclusively to the state or federal courts located within the State of New Hampshire.

Any prices and promotions that are listed on the Website are subject to change without notice. Payment is due before shipment of product(s).  In such case of any credit card payment, the payment terms shall be as set forth in the credit agreement of the cardholder.
Canceled orders paid with a credit card are subject to the credit card fees incurred by Video Hardware Services LLC  by processing your card. The Company’s shipping terms are F.O.B. (Freight On Board) Goffstown, NH.  Video Hardware Services LLC will arrange payment for shipping with the carrier, but the costs become the responsibility of the Customer.  The risk of loss is transferred to the Customer when Video Hardware Services LLC delivers the product in hand  to the carrier.  The Company is not liable for any delays in shipping and the delivery times are estimates only.

The Customer agrees to abide by any and all license provisions or end user agreement imposed by the publisher or manufacturer. Products (including equipment and software) sold internationally by Video Hardware Services LLC, may be exported from the United States only in accordance with the Export Administration Regulations.  Any diversion contrary to the United States law is prohibited. The customer represents and warrants that it is eligible to receive products under the United States law. The customer agrees to abide by any export or re-export restrictions imposed by the publisher or manufacturer. Video Hardware Services LLC cannot accept any credit card purchases for overseas products costing more than $200. Please contact sales@videohardware.com to arrange for a wire transfer.

Video Hardware Services LLC warrants that it has good title to any hardware (products) it sells, and that it has proper authority to license the software (products) it distributes.

All shipping Charges on the website assume a US location (excluding Hawaii and Alaska). If you are located outside of the continental US, your invoice will show a US shipping charge, and you will be contacted for the actual shipping charge to your country, and then you may decide if you wish to purchase the product.

Video Hardware Services LLC disclaims all other warranties, express or implied by law, including merchantability and use for a particular purpose even if the company has been informed ahead of time about these requirements. Video Hardware Services LLC does not warrant the performance or integrity of any product it sells; the Company passes through to the Customer whatever end-user warranty the manufacturer or software publishers provide with their respective products. Note --- Any statements made to you in the course of any prior, current, or future sale are subject to the year 2000 information and readiness disclosure act, (__U.S. C.__) (P.L. 105-271).  In the case of a dispute, this act may reduce your legal rights regarding the use of any such statements, unless otherwise specified by your contract or tariff.

The Limitation of Liability is as follows:

IN NO EVENT SHALL Video Hardware Services LLC BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT OR OPPORTUNITY. CUSTOMER'S SOLE AND EXCLUSIVE REMEDY IS STATED IN THE MANUFACTURER'S OR PUBLISHER'S END USER WARRANTY ACCOMPANYING THE PRODUCT. IN NO EVENT SHALL Video Hardware Services LLC’S LIABILITY EXCEED THE REPLACEMENT OR COST OF THE SPECIFIC PRODUCT PURCHASED. SOME STATES MAY NOT RECOGNIZE A DISCLAIMER OR LIMITATION OF WARRANTIES AND/OR LIMITATION OF LIABILITY SO THE ABOVE DISCLAIMERS MAY NOT APPLY. CUSTOMER MAY ALSO HAVE DIFFERENT AND/OR ADDITIONAL RIGHTS AND REMEDIES THAT VARY FROM STATE TO STATE.

Any return of products is subject to the Company’s current return policy as stated in the Return Policy. The standard terms and conditions of a sale are the complete and final agreement between a Customer and Video Hardware Services LLC for the matters set forth herein, and shall only be supplemented by the price(s), quantity, and descriptions on the Company’s invoice for the relevant sale.  Any terms contained in a Customer’s purchase order, offers to buy, terms and conditions, and the like shall have no effect to the standard terms and conditions of a sale.

These terms and conditions of a sale shall be interpreted by and be subject to the laws of the State of New Hampshire.  In any event, that any section or portion of a section are deemed to be unlawful or unenforceable, than that section or portion of a section shall be stricken from the sale, and the remaining terms and conditions shall continue to be in full force and effect. Video Hardware Services LLC shall not be responsible for damages or delays resulting from Acts of God, and from any other actions, both governmental and otherwise, including but not limited to war, riot, seizure, terrorism,  and embargo.
Video Hardware Services LLC may from time to time without notice modify these terms and conditions of a sale.

Video Hardware Services LLC reserves the right to change, alter, or cancel promotions listed on the website at any time without notice.  All promotions are subject to product availability.
